Photographer To GO Terms and Conditions

1. DEFINITIONS

  • "Company" refers to Photographer To GO, located in Richmond, Virginia.

  • "Client" refers to the individual(s) or entity engaging Photographer To GO for services.

  • "Services" refers to all offerings including but not limited to wedding photography, videography, engagement sessions, boudoir, digital downloads, wedding planning tools, and products.

  • "Agreement" refers to the legally binding contract formed by acceptance of these terms.

2. SERVICES PROVIDED

Photographer To GO offers:

  • Wedding photography (elopement to full-day packages)

  • Wedding videography (cinematic edits, highlight reels)

  • Engagement photo sessions

  • Boudoir sessions (by request)

  • Physical products (30-page Wedding Books, prints, USB drives)

  • Digital planning tools (timelines, checklists, spreadsheets)

  • Client management through "The Bridal Suite" portal

  • Online galleries and secure delivery of images

  • Social media content creation (if approved by client)

3. BOOKING AND PAYMENTS

  • A non-refundable retainer of $500 is required to reserve any wedding date.

  • Remaining balance is due on or before the wedding date, unless otherwise agreed in writing.

  • Payment methods include major credit/debit cards, PayPal (upon request), and approved third-party processors.

  • Failure to make timely payment may result in cancellation or delay in services.

  • Membership/Installment plans (if used) must be paid in full before service delivery; payments made under membership are non-refundable.

4. RESCHEDULING AND CANCELLATION

  • Clients may reschedule their event up to two times without penalty.

  • A third rescheduling incurs a $300 administrative fee.

  • Client cancellations forfeit the $500 retainer.

  • If Photographer To GO must cancel for any reason, all monies paid will be refunded, including the deposit.

  • Reschedules are subject to availability and must be confirmed in writing.

5. TRAVEL FEES

  • Services within VA, NC, MD, DC, and SC incur no travel fees.

  • Events outside these areas will require reimbursement for travel and lodging.

  • Clients must cover venue-specific photography permits if required.

6. DELIVERABLES AND TURNAROUND TIME

  • Photography delivery: Final edited images within 30 days of the event.

  • Videography delivery: Final edited films within 60 days of the event.

  • Rush delivery is available upon request for an additional fee.

  • All files are delivered via secure online gallery or download link. USB drives upon request.

7. FILE STORAGE AND BACKUP

  • Edited image and video files are stored by Photographer To GO for five (5) years post-delivery.

  • Raw files are not guaranteed to be stored.

  • Clients are responsible for downloading and archiving their files upon delivery.

8. CLIENT OBLIGATIONS

  • Provide finalized wedding timeline, venue info, and must-have shot list at least 7 days before the event.

  • Provide vendor meals for photography/videography staff for coverage over 5 hours.

  • Ensure access/permissions at all venues.

  • Notify Photographer To GO in writing if any portion of the event should not be photographed or shared publicly.

9. COPYRIGHT AND LICENSE

  • Photographer To GO retains copyright to all media until full payment is received.

  • Clients receive a non-commercial, personal-use license.

  • Clients may not sell, alter, or reproduce content commercially without written permission.

  • Photographer To GO reserves the right to use any images for portfolio, marketing, and promotional use unless the client opts out in writing prior to the event.

10. LIABILITY AND FORCE MAJEURE

  • Photographer To GO is not liable for missed moments due to late timelines, restrictions, or unforeseen client-side issues.

  • Not responsible for Acts of God, illness, weather, or other force majeure events.

  • Liability is limited to the total fees paid under the contract.

  • In the event of emergency or personal incapacity, the company will make reasonable efforts to find a replacement shooter.

11. REVISIONS AND COMPLAINTS

  • Clients are entitled to one (1) complimentary revision to their photo or video gallery within 30 days of delivery.

  • Additional revisions may incur an editing fee.

  • All complaints or disputes must be submitted in writing within 30 days of final delivery.

12. REFERRALS AND REWARDS

  • Clients may participate in the Referral Program.

  • $100 e-gift card awarded for each booked referral.

  • No limit to number of referrals.

  • Referrals must mention the client by name at the time of booking.

13. PLANNING TOOLS & SHOP PURCHASES

  • Digital downloads (timelines, checklists, budget planners) are sold as-is and are non-refundable.

  • Use of promo codes (e.g., PHOTOGRAPHERTOGO for 20% off) is subject to availability and expiration.

14. DATA COLLECTION AND PRIVACY

  • Photographer To GO collects names, emails, phone numbers, event info, and images for the sole purpose of fulfilling services.

  • Payment info is securely handled through third-party processors (e.g., Stripe, PayPal) and is not stored by us.

  • Client data is not sold to third parties.

  • Clients may opt out of marketing communications and request deletion of data.

  • Wedding images may be posted publicly unless written notice is provided.

15. ACCEPTANCE AND MODIFICATION OF TERMS

  • By booking a service, paying a retainer, or signing a contract, the client agrees to all terms herein.

  • Terms may be updated from time to time; clients will be notified of material changes.

  • Continued use of services constitutes agreement to the latest terms.

Cloud Storage – Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the cloud storage membership service (“Service”) provided by Photographer To GO (“we,” “our,” “us”). By signing up for this Service, you agree to these Terms in full. Please read them carefully.

1. Service Overview

The Service provides unlimited cloud storage designed for married couples to securely store their wedding, anniversary, and honeymoon photographs.
While the primary purpose of this Service is for wedding-related memories, clients may upload other images under the conditions outlined in Section 3.
You do not need to book Photographer To GO for photography services in order to use this Service.
The Service is available to customers in both the United States and Canada.

2. Membership and Payment

Membership provides unlimited storage for one primary gallery.
Additional folders may be purchased at a rate of $1 USD per folder.
To add folders, you will be sent a new membership agreement. Upon signing and activating the new membership, your old membership will be canceled to ensure you do not maintain multiple memberships simultaneously.
All payments are processed in U.S. dollars (USD). Canadian customers are welcome; their card provider will handle any conversion to CAD automatically.
Payment terms, renewal dates, and cancellation details will be outlined at checkout when you sign up.

3. Upload Policy

The Service is intended for storing wedding, anniversary, honeymoon, and related personal photographs.
You may upload other personal images; however, they must be stored within an additional purchased folder (see Section 2).
You agree that all images you upload:

  • Are owned by you, or you have the right to upload them.

  • Do not infringe on intellectual property rights of others.

  • Do not include unlawful, abusive, hateful, pornographic, violent, or otherwise inappropriate content.

4. Prohibited Uses

Uploading abusive, illegal, or harmful material is strictly prohibited.
If such activity is detected, your gallery will be immediately taken offline, and you will be permanently banned from all Photographer To GO services.
We comply with applicable laws and may report unlawful uploads to authorities.

5. Privacy and Security

Your gallery is private and password-protected. Access is limited to you and individuals you choose to share it with.
We will never use your media for marketing, promotional, or any other purposes.
While we take reasonable steps to safeguard your data, you acknowledge that no system is 100% secure. We recommend you also maintain personal backups of your files.

6. Service Availability

The cloud storage Service is hosted online and is accessible 24/7, subject to reasonable maintenance, updates, or outages outside of our control.
As long as your membership remains active and in good standing, your gallery will remain available.

7. Termination and Cancellation

You may cancel your membership at any time. Cancellation ends access to your gallery and storage.
If your membership expires or is canceled, your gallery may be removed from our servers. We strongly recommend downloading and backing up your files prior to cancellation.
We reserve the right to terminate your membership if you violate these Terms.

8. Limitation of Liability

Photographer To GO is not liable for loss of data, accidental deletion, or service interruptions.
You agree that the Service is provided “as is” and without warranties of any kind, either express or implied.
Our liability, if any, shall not exceed the total membership fees paid during the current membership period.

9. Amendments

We may update these Terms from time to time. If significant changes are made, we will notify members by email or via the membership portal. Continued use of the Service after changes are posted constitutes acceptance of the new Terms.

10. Governing Law

These Terms are governed by the laws of the state where Photographer To GO operates. Any disputes shall be handled in accordance with local laws and courts.

11. Annual Print Benefit (Free 5×7 in February)

  • Eligibility: Each active membership includes one free 5×7 print per membership year, available to order once each year during the month of February.

  • How to Redeem: We will provide ordering instructions via email or the membership portal during February. Orders must be placed within February (local time).

  • Image Source: The print must be created from an image stored in your active gallery.

  • Limit: One free 5×7 print per membership year, per active membership. No cash value. Not transferable.

  • Rollover: Unused free prints do not roll over to subsequent years.

  • Shipping: Standard shipping within the U.S. is included. Additional charges may apply for expedited shipping or international delivery.

  • Quality & Reprints: If your print arrives damaged or defective, contact support within 14 days of delivery for a replacement.

  • Abuse: We may deny or revoke the benefit in cases of suspected fraud, misuse, or violation of these Terms.

12. 6-Month Money-Back Guarantee

  • Coverage: New memberships are covered by a 6-Month Money-Back Guarantee starting on the date of initial purchase.

  • How it Works: If you’re not satisfied for any reason within the first six (6) months, contact support to request a refund. We may ask for feedback so we can improve the Service.

  • Effect of Refund: Issuing a refund will cancel your membership and remove access to your gallery. We will schedule deletion of stored files after 30 days; please download your files before the refund is processed.

  • Exclusions: The guarantee does not apply to accounts terminated for violation of these Terms, fraudulent activity, or abuse of the Service or promotional benefits.

  • Scope: Refunds cover membership fees paid to Photographer To GO for the current guarantee window. Third-party fees (e.g., rush shipping for prints, bank/foreign exchange fees) are not covered.

Photographer To GO

Annual Wedding Photobook Giveaway

  1. Eligibility & Selection

    • This giveaway is only available to couples with an active paid gallery storage membership.

    • Each year, one (1) eligible member will be randomly selected to receive a complimentary wedding photobook.

    • Participants must be 18 years of age or older at the time of selection.

    • The selected couple will be notified by email.

  2. Acceptance & Redemption Process

    • The selected couple will have 7 days to accept the offer by replying to our email.

    • Upon acceptance, we will provide the official Terms and Conditions for review.

    • After acknowledgment, a link will be sent to upload images to the photobook gallery.

    • The couple must email us once uploads are complete to proceed with production.

  3. Book Specifications

    • The complimentary photobook will include up to 50 pages and a maximum of 100 images.

    • Couples may select the images, but the order and layout of the book will be determined solely by Photographer To GO.

  4. Delivery & Acceptance

    • The photobook will be shipped free of charge to the selected couple.

    • Acceptance is optional. If declined, another member will be chosen.

  5. Limitations

    • The photobook is non-refundable.

    • Only one complimentary copy will be provided.

    • No free reprints will be issued. Additional copies may be purchased for $500 each.
